Set-Out Procedures In order to provide the most efficient service to all landlords and property managers, the following procedures have been adopted. The law requires that the Court serve a twenty-four (24) hour notice upon any tenant who has been ordered evicted prior to actual ejectment. Any landlord or property manager who desires that a tenant be ejected must pay a $10.00 filing fee for a Writ of Ejectment in the Civil Division of the Spartanburg Magistrate Court. Before leaving our office, landlords and property managers should have the names and case numbers of all tenants for whom a Writ of Ejectment has been requested. Our constables will only serve the twenty-four hour notice of eviction on Tuesdays and Wednesdays. Ejectments will be executed on Thursdays. Ejectments will be executed in the order that they are filed. Landlords and property managers must have workers available to move the property of the tenant during the set-out. There must be enough workers available to move the tenant's property as quickly as possible in order for the constables to be able to complete the set-outs scheduled for the rest of the day. If adequate labor is not provided, the constables will need to move on to the next set-out. The constables are only present at the set-out to insure that the landlord is put in possession of the rental property. This procedure will allow the constables to use their time more efficiently. The civil division staff appreciates your assistance and cooperation in these procedures. Landlords please remember that all forms must be notarized and you must have two (2) copies of all papers to be filed. Remember to sign with your signature and not a company name.
